Terms of Service
The terms governing your use of the HIMS website and software platform. Last updated: 26 August 2026.
1. Agreement
By accessing this website or using the HIMS platform ("the Service"), you agree to these Terms of Service. If you are entering into this agreement on behalf of a hospital or organization, you represent that you have authority to bind that entity. If you do not agree, please discontinue use.
2. The Service
HIMS is an ABDM-enabled Hospital Information Management System that provides OPD, IPD, billing, diagnostics, compliance, communication and analytics modules. Features may evolve; we may add, modify or retire functionality with reasonable notice. Paid plans are subject to a separate Subscription Agreement.
3. Accounts & security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access. You must provide accurate registration information and keep it current.
4. Acceptable use
You agree not to: (a) use the Service unlawfully or for any purpose prohibited by these terms; (b) attempt to gain unauthorized access to other accounts or systems; (c) upload malicious code; (d) resell or white-label the Service without written permission; or (e) submit patient data without the lawful authority and consent required under applicable law, including the DPDP Act and ABDM guidelines.
5. Subscription, fees & setup
Subscription fees are billed monthly or annually as selected. A one-time setup fee is included in all standard plans; custom deployments may be quoted separately. Fees are exclusive of applicable GST. Failure to pay may result in suspension of the Service.
6. Intellectual property
The HIMS software, website content, branding and documentation are owned by HIMS Technologies Pvt. Ltd. and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription term. Hospital data entered into the platform remains your property.
7. Data & privacy
Use of the website is governed by our Privacy Policy. Processing of patient data within the platform is governed by our Data Processing Agreement, available on request.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement. We do not warrant uninterrupted or error-free operation.
9. Limitation of liability
To the maximum extent permitted by law, HIMS shall not be liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill, arising from use of the Service. Our aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.
10. Governing law
These terms are governed by the laws of India, with courts in Bengaluru, Karnataka having exclusive jurisdiction.
